Important Workplace Law Updates
FTC Bans Most Noncompete Agreements: The Federal Trade Commission (FTC) has voted to prohibit for-profit U.S. employers from imposing noncompete agreements on their employees, potentially impacting tens of millions of workers. The FTC argues that noncompete clauses limit job switching, depress wages, impede innovation, hinder entrepreneurship, and undermine fair competition. The new rule bans the creation of new noncompete agreements and renders existing ones unenforceable, with an exception for senior executives earning over $151,164 annually in a policy-making position. The FTC views noncompete agreements as exploitative, particularly for rank-and-file employees who often lack negotiation power. Confidentiality clauses are suggested as an alternative for protecting trade secrets. The nationwide ban supersedes state laws, with some states already having restrictions on noncompete clauses. The FTC projects significant economic benefits, estimating up to a $488 billion increase in wages and benefits over a decade due to the ban.
US Supreme Court Unanimous Ruling on Workplace Discrimination:
The U.S. Supreme Court unanimously ruled in favor of a St. Louis police officer, Jatonya Muldrow, making it easier for employees to bring workplace discrimination lawsuits. Muldrow claimed she was transferred to a less desirable position due to her sex, challenging a lower court's dismissal of her case. The Court clarified that Title VII of the Civil Rights Act of 1964 does not require employees to prove significant harm such as pay cuts or job loss to establish discrimination. This decision supports employees who face discrimination in various forms, not just those resulting in major employment consequences, and resolves a split among U.S. appeals courts.
Florida’s New Chase Policy:
The Florida Highway Patrol has revised its pursuit policy, granting state troopers more authority to initiate car chases and allowing them to exceed speed limits or drive against traffic, as reported by Stateline. This shift contradicts advice from experts and data indicating that fewer restrictions on pursuits lead to greater road hazards. While many states and law enforcement agencies have limited chases to situations involving violent felonies or imminent public danger, Florida's new policy emphasizes troopers' discretion and swift resolution of chases. The decision aligns with Governor Ron DeSantis' stance on law enforcement but raises concerns about public safety. Despite evidence from other states showing increased chases and decreased apprehension rates after loosening pursuit restrictions, the Florida Highway Safety Department declined to comment on the statistics.
